By registering your school in the 'Why Does Money Matter?' Competition you accept the Terms and Conditions for the competition.

Financial Services Council 'Why Does Money Matter?' Competition Terms and Conditions.

1.        Eligibility and How to Apply

(a) The Financial Services Council (FSC, us) 'Why Does Money Matter?' Competition (the Competition) commences at 8:00am on Monday 27 June 2022 with the last time for submitting entries being 11:59pm on Friday 30 September 2022 (the Competition Period). 

(b) Entry is open to all New Zealand Primary and Secondary Schools (Schools, you or your).

(c) The Competition provides an opportunity for Schools across New Zealand to enter the Competition and win one of five (5) $NZD2,000 prizes (the Prize). The Prize will be provided to winning Schools in the form of a direct payment by Friday 4 November, 2022.

(d) To enter the Competition, Schools must complete the online entry form, which is available through the Competition website, www.moneyandyou.org.nz/why-does-money-matter-competition. Entries must answer all of the questions in the application form. By entering the Competition, the School agrees to be bound by these Terms and Conditions.

(e) Schools may submit more than one entry.

(f) False, misleading or inappropriate entries will be disqualified. The following entries shall be deemed invalid:

I. incomprehensible or incomplete entries;

ii. entries that infringe the intellectual property right of third parties or that are plagiarised;

iii. entries that are considered by FSC to be inappropriate or offensive at the FSC’s discretion; or

iv. entries that do not comply with these Terms and Conditions.

(g) Each School warrants that all information provided in relation to its entry or entries in the Competition is true and correct to the best of the School’s knowledge and is not misleading whether by omission or otherwise.

(h) The School acknowledges that it is their responsibility to ensure they obtain the appropriate permissions and consents from individuals (including any applicable parental consents of any pupil identifiable in the Content), community groups and other relevant third parties associated with their entries to ensure you can meet the obligations in these Terms and Conditions.

(i) On submission, all valid entries become the property of the FSC. The FSC may collect and use information gathered as part of the Competition to enhance its financial wellbeing programme offering and inform future marketing and events.

2.        The Selection Process

(a) A panel of FSC appointed judges (the Judges) will review all valid entries that are eligible for consideration for a Prize. The Judges will assess the merits of each application and select the successful Schools. Any Prizes awarded will be at the discretion of the Judges and any decision as to the Prizes will be final.

(b) FSC reserves the right to change these Competition Terms and Conditions, as well as the nature, period, scope and any details or elements of the Competition, or cancel the Competition at any time, by giving notice to the Schools via email or through published information on the FSC website.

(c) Schools that have been awarded a Prize will be contacted by the FSC via the contact details provided in the entry form. If FSC is unable to contact a successful School after three attempts, that School will forfeit the Prize and the judges will select another successful application in their place.

(d) The FSC’s decision and the decision of the Judges is final on all matters relating to the Competition including Prizes. The FSC need not provide any explanation for any decision made regarding any entry, including any entry that is deemed invalid pursuant to clause 1(f) of these Terms and Conditions.

3.        Publicity and Promotional Schools

(a) By entering the Competition, the School confirms that:

I. You created and own or have a licence to the copyright in the photograph, video or other content submitted as part of your entry (Content);

ii. You grant us a non-exclusive, royalty-free, perpetual and worldwide licence to use the Content (and any derivative works) for any marketing or advertising purpose;

iii. All people identifiable in the Content, including any employees or contractors of the School or pupils of the School, have consented to the creation, posting and use of the Content; 

iv. Any applicable permissions or contents as outlined in clause 1(h) of these Terms and Conditions have been obtained; and

v. You will not bring any claim against the FSC in relation to the use or non-use of your Content (or any derivative works), including any claim based on moral rights.

(b) As the copyright owner or licensee, the School understands and acknowledges that:

I. The Content or parts thereof may be reproduced in any way in any current or future media (including, but not limited to, online and social media) and may be combined with any other content, works or text in any way that the FSC deems appropriate whist maintaining the Content integrity at all times;

ii. The FSC may use your Content, but is not obliged to use your Content; 

iii. To the extent that the FSC’s use of your Content creates a new copyright work (derivative work), the FSC is the exclusive owner of that new copyright work, including any moral rights in that work;

iv. To the extent that you, pupils of the School or other people feature in the Content, these images may be used by us in advertising or marketing materials;

v. The FSC may store copies of the Content for the purposes noted in this clause 3(b); and 

vi. The FSC may continue to use the Content in existing advertising or marketing until such time as the FSC considers appropriate.

(c) Successful Schools may be required to attend a presentation ceremony and agree to any print, television, social media, or promotion personnel covering the Competition to photograph, interview and report on the Competition. This is at the FSC’s sole discretion.

4.       Privacy

(a) All information that you provide as part of this Competition will be held securely by the FSC and will be used for the purposes of assessing entries for a Prize, and if the entry is successful, for the purposes of processing the Prize. This will include disclosure to any third parties who have been engaged by the FSC to manage the Competition. You have the right to access and correct personal information in accordance with the Privacy Act 2020. A copy of the FSC’s privacy statement is available from here.

(b) Schools have the right to access and may change or update details, such as change of email address by emailing hello@moneyandyou.org.mz

5.        Liability

(a) The FSC shall not be liable for any loss, damages or injury (including but not limited to indirect or consequential loss) which is suffered or sustained arising out of or in connection with the Competition, the taking or using of any Prize, or any act or omission (whether negligent or otherwise) of the FSC or any of their associated agencies, except for any liability which cannot be excluded by law.

(b) Without limiting the foregoing, the FSC assumes no responsibility for, and any School that submits an entry or entries release the FSC from, any loss, claim, damage or injury to any person or property if, for any reason beyond the FSC’s reasonable control such as, but not limited to, computer viruses, tampering, unauthorised intervention, fraud and technical failures. 

(c) In the event that this Competition is not able to be conducted as planned and or the Competition’s administration, security, fairness or integrity are corrupted or affected, the FSC may, at its discretion, modify or suspend the Competition and or invalidate any entry or entries of any School involved (including the actions of its pupils) in interfering or tampering in any way with the conduct of the Competition or abusing the communication system upon which the Competition is being conducted.

(d) Where goods or services are supplied by third parties, the FSC does not warrant the quality of those goods and or services or the suitability for a particular circumstance. To the extent permitted by law, the FSC excludes liability for any loss suffered as a result of the use of those goods and or services.

(e) The FSC assumes no responsibility for any failure to receive any entry or entries as a direct or indirect result of a technical problem or any form of internet malfunction. Entries are deemed to have been received at the time of receipt of transmission into the FSC website database, not the time of transmission by the School.

These Terms and Conditions are to be governed by and construed in accordance with the laws of New Zealand.
